CONDITIONS OF HIRE
1. RESPONSIBILITY OF HIRER
The goods hired a believed to be in good working order and in a safe condition when they leave our premises. Nevertheless the HIRER on receipt of the equipment and from time to time during the hire should inspect the goods hired and satisfy themselves that they are and continue to be sound and sufficient for any purpose to which they may be applied and comply with all statutory regulations. The Hirer's acceptance of the plant shall be conclusive that he has examined it and found it to be in good working order and safe condition. All goods are deemed to be in good order and condition to the complete satisfaction of the HIRER unless LAS Agric Ltd receive notification to the contrary form the HIRER within 24 hours of collection.
2. NON LIABILITY AS TO GOODS HIRED
LAS Agric Ltd do not guarantee or warrant the soundness or efficiency of the goods and will not be responsible for any damage or loss which may occur through their unfitness. Any condition statement or warranty implied or otherwise not expressly stated herein is hereby excluded. The hiring shall continue until the goods are returned by the HIRER and the hire shall be considered as accruing from day to day. In the event of unforeseen cause or delay, the hire may be postponed until it again becomes possible. Such postponement shall not give rise to any claims against LAS Agric Ltd or their agents, employees or subsidiary companies for breach of contract or otherwise nor shall they entitle the HIRER to cancel the contract of hire.
3. OWNERSHIP OF GOODS
All goods on hire remain the property of LAS Agric Ltd and the HIRER shall:
• Notify LAS Agric Ltd immediately of any defect patent or latent in the mechanical condition of the said goods
• Not mortgage, charge, pledge, assign, underlet or otherwise deal with the said equipment or suffer it to be taken out of the United Kingdom under any circumstances whatsoever without the previous consent in writing to LAS Agric Ltd
4. DEPOSIT
A deposit is to be paid by the HIRER in all cases where there is no Ledger Account. Such deposits will be held as security against the return of the goods hired and unless so agreed no part of the deposit will be available to satisfy the hire charges which must be paid monthly or at more frequent intervals as may be required by LAS Agric Ltd. At the termination of the hire the deposit shall be refunded expecting that LAS Agric Ltd reserve to themselves the right of applying the deposits in hand on any goods toward or in payment of any unliquidated balance that may be due to them on any account from the same HIRER.
5. HIRE CHARGES
All good had on hire must be taken from and returned to the premises of LAS Agric Ltd at the expense of the HIRER. All deficiencies or damage to the goods on hire will be charged for, together with any hire charges due, up to and including the day on which such deficiency or damage has been ascertained. Goods hired for part of a day may be charged as a full day and the day of hiring and the day of return may be charged as two separate days.
6. TRANSPORT
Collection and delivery is not included in the RATES OF HIRE and will be charged extra according to the time and distance involved.
7. DAMAGE TO PLANT HIRE
The HIRER is responsible for the safe custody of the goods on hire and for their use in a proper and workmanlike manner shall insure them and keep them insured against all risks. If any of the goods on hire is lost, stolen or damaged in any way whatsoever (fair wear and tear expected) whilst in the possession of the HIRER, the cost of replacement or of making good the damage shall be borne by the HIRER.
